Backpack of Songs

Terms of Use — Backpack of Songs

Version 1.0 — effective September 15, 2026

1. Who we are, and what this document is

Backpack of Songs ("the app") is provided by Leonardo Rodrigues Muller ("we", "us").

These Terms are the agreement between you and us about using the app. By creating an account you accept them. If you do not accept them, do not use the app.

Two other documents are part of this agreement:

2. What the app does

You leave the song you are listening to at the place you are standing. Other people passing near that place find it later, and can keep it in their backpack.

Three things follow from how it is built, and you should read them as part of the deal rather than as features:

  1. Nothing you post appears for an hour. Every post is held for one hour before anyone else can see it. This is enforced by the database, not by the app.
  2. Posts are visible to strangers near the place you left them. Anyone using the app within roughly 1.6 km of that point can see the track, the note you wrote, and — unless you posted anonymously — your display name, your chosen portrait and your country.
  3. The app does not play music. It shows track information and opens the track in Spotify. Playback, audio and your listening history are Spotify's, under Spotify's own terms.

3. Who may use it

You must be at least 16 years old. If the law where you live sets a higher age for agreeing to terms like these on your own, that higher age applies.

You may not use the app if we have previously terminated your account, or if sanctions or local law prevent us from providing it to you.

4. Your account

You sign in with Apple, Google or Spotify. We never see or store the password you use with them.

You are responsible for what happens under your account. Do not share it. Tell us at support@backpackofsongs.com if you think someone else has access to it.

One person, one account. Do not create accounts to evade a suspension.

Your display name, your country and the portrait you pick are shown to other people on the posts where you chose to be identified. Choose a name you are comfortable being seen.

5. Location

The app needs your location to work. It is used to draw your radar, to find posts near you, and to attach a place to what you post.

You give this permission through your phone, and you can withdraw it there at any time. Without it, the app cannot show you anything nearby.

Think before you post from where you live. A post is a public statement that someone was at a place. The one-hour delay means nobody can follow you in real time, but it does not make a location private. Do not post from your home, your child's school, or anywhere you would not want a stranger to associate with you.

6. What you post

You keep your content. The note you write and the choices you make are yours. We do not claim ownership of them.

You give us a licence to run the service. To show your post to other people, we need permission to store it, copy it, transmit it and display it inside the app and its backups. That licence is worldwide, royalty-free and non-exclusive, and it exists only for operating and improving the app. It ends when you delete the content or your account, except for copies in ordinary backups, which age out on their normal schedule.

We will not sell your content, put it in advertising, or license it to anyone else.

You promise that you may post it. By posting, you confirm the content is yours or that you have the right to share it, and that sharing it does not break the law or someone else's rights.

Anonymity has limits. When you post anonymously, our server never sends your name, portrait or country with that post — it does not leave the database. But what you write can still identify you, and we retain the link between you and the post internally so that we can enforce these Terms and answer lawful requests. Anonymous means anonymous to other users, not to us.

Posts are not private messages. Do not put anything in a note that you would mind a stranger reading, screenshotting or keeping.

7. What you may not do

The full list is in the Community Guidelines. In summary, do not post content that is illegal, hateful, harassing, sexual involving minors, violent, deceptive, or that exposes someone else's personal information. Do not use the app to track, follow or intimidate a specific person.

Do not attack the service either: no scraping, no automated access, no reverse engineering beyond what the law allows you, no attempts to read data you were not meant to read, no spam, and no using the app to build a competing dataset.

8. Reporting and moderation

Every post has a way to report it, and you can block a user so that their posts stop appearing for you. Reports go to support@backpackofsongs.com as well.

We review reports and aim to act on them within 24 hours. We may remove content, hide it, or suspend or terminate an account when these Terms or the Community Guidelines are broken, or when we are legally required to.

We are a small operation and we do not read everything before it is published. We rely on reports.

If we remove your content or suspend your account, we will tell you why where we can, and you can reply to that message to contest it.

9. Spotify

Spotify is a separate service run by a separate company. To connect it you need your own Spotify account and you must accept Spotify's terms.

If Spotify changes or withdraws its interface, parts of the app may stop working. That is outside our control.

10. Maps

Map imagery comes from OpenStreetMap contributors and CARTO. Their attribution is shown on the map and their terms apply to the imagery.

11. Money

The app is free. There are no ads, no subscriptions and no paid features. There is no way to pay from inside the app, and nothing in the app links to a place where you can.

The website has a tip jar. If you choose to support the project you can do so there, and that is a voluntary gift: it buys nothing, unlocks nothing, gives you nothing extra in the app, and is not refundable except where the law requires it.

12. The service changes, and sometimes breaks

We may add, change or remove features, and we may stop offering the app altogether. If we shut it down we will give notice in the app and by email where we have one, with enough time for you to export or delete what matters to you.

We do not promise the app will be available without interruption. It depends on your phone, your connection, and services we do not control.

13. Deleting your content and your account

You can delete any post from the app at any time.

You can delete your account from the app's settings. When you do:

Some records are kept after deletion where the law requires it, or where we need them to enforce a suspension. The Privacy Policy says exactly which, and for how long.

14. Our own rights

The app, its name, its pixel artwork, its code and its design belong to us or to our licensors. These Terms do not give you any right to use them beyond using the app as intended.

15. Disclaimers and liability

The app is provided as it is. We do not warrant that the content other people post is accurate, lawful or safe, and we do not check it before it appears.

We are responsible for damage we cause you by breaking this agreement or by our own fault. We are not responsible for what other users do, for what Spotify or your phone's operating system do, or for losses we could not reasonably have foreseen.

Nothing in this section limits any right you have under mandatory consumer protection law — in Brazil, the Código de Defesa do Consumidor — or excludes liability for fraud, wilful misconduct, death or personal injury.

16. Changes to these Terms

When we change something that matters, we will tell you in the app and ask you to accept the new version before you keep using it. Small corrections take effect when we publish them, and the version and date at the top always tell you which text applies.

Every previous version is kept. Ask at support@backpackofsongs.com if you want to read one.

17. Ending this agreement

You can stop at any time by deleting your account.

We can suspend or end your access if you break these Terms or the Community Guidelines, if we are legally required to, or if we shut the service down.

Sections 6 (the licence, for content already shared), 13, 14, 15 and 18 survive the end of this agreement.

18. Law and courts

These Terms are governed by the laws of Brazil.

If you are a consumer, you may bring a claim in the courts where you live, and you keep every protection your local consumer law gives you. Otherwise, the courts of Porto Alegre, Rio Grande do Sul have jurisdiction.

19. Terms that Apple and Google require

Apple. These Terms are between you and us, not Apple. Apple has no obligation to provide support for the app, and no responsibility for it or for any claim about it — including product liability, a failure to meet a legal requirement, or a claim under consumer protection or privacy law. Apple is not responsible for investigating or resolving any claim that the app infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government restricted-parties list.

Google. These Terms are between you and us, not Google. Google is not responsible for the app or its content.

If you have a problem with the app, write to support@backpackofsongs.com first, not to Apple or Google.

20. The rest

If part of these Terms turns out to be unenforceable, the rest still applies. Not enforcing something once does not mean we give up the right to enforce it later. You may not transfer this agreement; we may, if the app changes hands, and we will tell you if that happens.
